Roggenkamp v Bennett (1950) 80 CLR 292

This case considered the issue of voluntary assumption of risk and whether or not a drunk driver could rely on the defence of volenti non fit injuria in relation to the injuries suffered by a passenger in the car when the car he was driving crashed after they had both been drinking heavily.
