Mehmet v Benson (1965) 113 CLR 295

This case considered the issue of time clauses in contracts and also the remedy of specific performance and whether or not time was of the essence in relation to instalment payments for a property and if a purchaser could seek the remedy of specific performance even though they had not paid some of these instalments on time.
