Carr v JA Berriman Pty Ltd [1953] HCA 31; (1953) 89 CLR 327

This case considered the issue of termination of a contract and whether or not a builder lawfully rescinded a contract for the construction of a building after the owner of the land on which the building was to be constructed had failed in his obligation to excavate and prepare the site ready for construction and had contracted with another builder for the supply of materials.
