Bendal v Mirvac Project (1991) 23 NSWLR 464

This case considered the issue of trespass and whether or not an encroachment into airspace above a building by the construction of a neighbouring building amounted to a trespass.  Furthermore if there was a hardship inflicted upon the builder if the encroachment was to be removed.
