Italiano v Barbaro (1993) 114 ALR 21

This case considered the issue of joint illegal enterprise in relation to negligence and whether a driver and passenger acting jointly in the furtherance of a criminal conspiracy were in a proximate relationship and whether or not it was appropriate or feasible to define a duty of care owed by one participant in a joint unlawful activity to another.
