Australian National Airways v Commonwealth (1945) 71 CLR 29

This case considered the Commonwealth’s trade and commerce power in s.51(i)  and whether or not the Commonwealth government had the power to commence an airline service between the State’s and Territories.   The question was whether the Commonwealth could operate in activities with respect to trade and commerce or just regulate activities with respect to trade or commerce.
